Problem: USCIS is not following FIFO
Why are they not following FIFO: Becoz they don't want to waste visa's. If I am USCIS what am I supposed to do. If I waste visa I get smacked. If I try to use up visa I get smacked ;) So what am I supposed to do with the limited resources:confused:
SOLUTION
Provide a provision for USCIS to automatically recapture unused visa's - this will give USCIS a buffer so that they don't act crazy in the last quarter - This provision already exists in HR 5882, this benefits everyone
Short Term - Gather a group of affected ppl and meet with USCIS and Immigration subcommittee chair's and present the issue and let Congress put pressure on USCIS to follow FIFO.
Note: My understanding is that USCIS is not doing any unlawful thing (guidelines aren't a law) by not following FIFO, but however it is unfair.

It is a shame to see high-skilled folks stoop to such low-levels (EB2-3 fights) just to get a card. Please have basic etiquette - respect for fellow professionals. EB1/EB2/EB3 is just a classification based on job description, America needs every category, so please respect those category members. Every category is inter depended on each other. For example: don't tell me that an EB1/2 fellow doesn't require EB3 folks for his/her professional growth.
Please stop this EB1/2/3 category fights and focus on a long lasting solution to the retrogression problem.
Let us have a healthy debate to solve the problem rather than fighting over silly comments..

Our nation holds paramount equal treatment under the law. My principal question is, what federal laws may I break so that I am rewarded with amnesty to the tune of $18,000 per year?
That would bring me parity with the estimated costs to society of illegal aliens. These are in health, education and related social benefits. Oh, and the approximately 30 percent of our prison population which is comprised of some of these aliens. Seems some of the cost is borne by victims who are assaulted by aliens doing the crimes Americans just won�t do.
I�ll even give you a bargain. As a small business owner, my real and opportunity costs to comply with federal statutes and regulations are substantial. These are not taxes, they are non-deductible costs I incur to comply with federal law. My daughter�s chronic medical condition and my own heart condition also incur substantial expenses. Regarding our health, my family is uninsurable due to these conditions. We have never received assistance under any state or federal programs.
All of these costs come to something over $27,000 per year. So, when you give me my amnesty and my $18,000 per year, you will fall short of my expenses by approximately $9,000. Since you are wise in the ways of federal accounting, you can inform your constituents that you have in fact saved $9,000 per year, in addition to the moral claim of having granted me amnesty.
It will be appropriate to consider that in fairness my children should be due anchor amnesty. This from the fact that they still will be my dependents when you soon grant me amnesty. If you delay, well, my daughter will always be my dependent.
Considering possible delays, especially since fellow citizens will have their own tailored amnesty petitions, I understand if you need to charter a Federal Amnesty Commission. That is sure to renew respect for and compliance with the laws you draft. Any shortfall in compliance, up to say, twelve million offenses, you could graciously accept as appropriate civil disobedience. After all, that would assure you more press time as we enter this latest election cycle.

I have a question about Landing with Own car? Is there a way to get around importing it? I want to use my own car but don't want to pay import fee etc. Did they charge you anything? How much was it? My labour and I-140 is approved last year and I am working with current employer from last 1 and half years. Employer is making good money trough me.
As now the dates are current, my employer is trying to exploit me.
He is not responding to my mails, and not picking my phone.
Last modified message which I got from him is that:
The whole financials for the company changes with filing 485 for you immediately. So, it is definitely a loss for company to process your 485 immediately.
you need to come with items that you are ready to compromise in return; so that the company also benefits by helping you."
I am very much in tension and he is talking to me.
Can someone suggest what may be the option for me?
This is really a sorry situation. On one side your employer is saying wholy company's fiancial is dependent on you and on other side he is asking how can you benefit company. There is not much you can do other than doing a sweet talk him and see if you can come up with some compromise.
He might ask you to sign some bond to stay in the company for next few years. See if you can reduce that duration as well as get the surety that will not impact your increment.
Although several people will advise you for the aggresive stance but I don't think you would like to move in that direction.
Other option is to file your I-485 youself or through some attorney ( other than your employer's), if you have the employment letter and I-140 approval.

There are some jobs that require US citizens only without any security clearance requirements. Many defense related projects are like that. Not everyone will need security clearance, but everyone in the project must be US citizen.

In reality, a common man does not do much analysis and just goes by the flow. HR listens to what manager or management says and thats it. No one complains or asks and as such people - if they find an opportuinity which is welcoming will not chase an opportunity which is not welcoming unless a group of people like members of IV - want to collectively address these issues.
When I looked for jobs I have seen employers or reqruiters asking what is my status and if I say I have EAD some of them will say "OK, no problem" but will not get back because they have instruction from hiring managers to hire only GC or USC. The hiring manager may not be well informed enough or may not want to deal with things with USCIS (perception, because all USCIS wants is a verification letter which is common and other agencies like Banks, DMVs etc.. may also request the same)
I have noticed that a lot of people are not comfortable about dealing with USCIS - it could be a stigma.

In my very initial thoughts, on July 2 and July 3, I believed the lawsuit had no chance; but in following this more closely and doing my own research, I think increasingly that the lawsuit has merit. USCIS and DOS appear to have violated various of its internal rules and arguably actual statutes and regulations in handling all this.
Not that I am holding my breath, but just wanted pass it on....

1. Will they make the July visa bulletin current again?
2. If not, will they allow everyone to file for EAD and AP?
