    no photo is required. They might take a photo of you if they think its old. You can take fresh photos if you want but I don't think that you will need it.

    Now the next thing. You will definitly be asked and might also be threatened by the US immigration officer when you tell them that you went to canada for landing and you have also applied for US immigration. You can be lucky and might not be asked this question but there is a great possibility that it will be raised. Although there is no law that says you cannot obtain PR for any other country as long as your application for US PR is pending, you will be harassed when you tell them that you are in US on AOS. Remember one thing: DO NOT TELL IO THAT YOU PLAN TO ABANDON CANADIAN PR ONCE YOU GET US PR AS YOU WILL BE COUNTER ASKED THAT YOU HAVE WASTED THE CANADIAN VISA NUMBER AND ALSO PLANNING TO WASTE THE VISA NUMBER AS ANOTHER INDIVIDUAL WOULD'VE GOT THAT. Just stay calm and let them say whatever they want to say.

    My PD is Oct 2006. Its seems like i have to wait around 10+ years. Do you think i should go for EAD instead of H1B transfer and H1B extension

    I think you will get in less than 2 years. It will not take 10 years. Hang on. Total GC process time from applying to labor to getting GC usually is 4 years. some unlucky people had to wait more than that. But more than 80% fall in to 4 year time line.

    but some were lucky people got it quickly because they could cut lines.

    Running this thread to thousands of pages alone is not gonna help us. Do you guys have a conference call where I can join and take up some action items?
    IF IV has to throw its might behind this bill we need to:
    -Reach out to ALL lawmakers, target who are susceptible (Sen. Brown from MA for example)
    -Use phone calls (Can we have a mass phone campaign)
    -Radio shows (Do we have a Radio show in Washington DC where IV can get Air time. I am sure lawmakers do listen to Radio shows)
    -Email (what this thread is about right now)

    Hi Jamie,

    I do not think anyone should doubt the hard work and sincerity of illegal immigrants - be they mexican or any other nationality. All these folks come to USA seeking a better life. It is a fact that politicians have used illegal immigration to their advantage - how it suits them at a particular point in time. SO I do respect the hard working nature and contribution of illegal immigration.

    However you will have to appreciate that the government's policy of grouping legal and illegal immigrants in any legistative decision has proven to be a nightmare for the legal immigrants. You will also appreciate that issues and circumstances surrounding legal immigrants are substantially different from illegal immigrant issues. However legal immigrants have to face the brunt of retrogression and other processing delays due to:
    1) A nonsensical approach of first letting illegal immigrants to work here, not giving them their rights for long years or enforcing the laws to deport them and then suddenly legalizing the illegals, without improving INS/DHS processes or infrastructure/Visa quotas.
    2) Prospects of another huge influx of legalization which as we all know, the INS is not capable of processing with its existing operational capabilities.

    I am hopeful that whatever law emerges in the next year or two should handle illegal and legal issues separately. As far as xenophobia towards hispanics, everybody has their own view, so you cannot unfairly generalize that Indians have this racism towards mexican illegals. Personally, I do not have a problem with people expressing their ethnic identity, but as we know everybody need not think like us and everybody is entitled to an opinion.

    Good luck and please continue to work for relief for legal immigrant community.

    Second, re "permanent" job, the Yates memo clearly doesn't say that requirement--the RFE you quoted does . Also, since no source has been able to define what a "permanent" job is, I said that ALL contract jobs and self-employment can be shown to be permanent. Surprisingly, your interpretation is that NO H-1B job is "permanent!"


    Now you have changed stand on these two after seeing one RFE example.
    I did not change my stand on "permanent" job--no source has been able to define what that is. So, inserting that in the EVL in case of as RFE should not be a problem.

    Now, you are saying new AC-21 job does not be bonafide.
    I'm not saying that the "AC-21-job does not be bona fide." You *assumed* that, which is what you need to stop in your arguments. All I asked you is, where did you read that?

    If the options are sign or do not sign and no EAD/GC for a long long time or never, I would just sign the damn thing. This contract is way too restrictive and lawyers will find lot of loopholes. Let him go to court. If he dares to, what do you lose? $10,000? He has to spend more than that, face publicity, lose reputation among clients ( send the freaking agreement to all his clients and advertise in all awebsites) and intense scrutiny by Homeland Security and possible arrest. Just somehow document all your conversations which implicate him and be prepared.

    Careful my friend. Porting rules will be as tough as the rules for applying in Eb2. If you make porting difficult, you will set a higher standard for the approval of your application in Eb2 ending up with the possible rejection of yours and other Eb2 applications.

    Why would you want to stop someone eligible to apply in Eb2? If someone has met all the criteria, the same criteria you had to fulfill when applying in Eb2, then what is the problem?

    Yes, I am here for around 12 years with no GC and I won't mind if someone interviews me to cover my story, also will submit my story in 'tell your story' thread.Today, I have signed myself in Ohio chapter to meet like-minded souls...

    I have some problem on surfing & responding back because our "Big Brother" wathces who is surfing for how much time and also he/administrator did blocked Yahoo/Hotmail & all mail related to website..thats usual story for "Consultant Contractors"...

    I have one question, did you have any trouble while getting mortgage approval? Do you think in the changed scenario in US housing market, people like us will have problems in getting approval b'cos of our residency status and recently tightened regulations?

    Well said eager_immi. Getting GC and getting job and earning is not the only thing in life. I have seen many many couple who are gc holders and citizens, giving up their career to bring up the kids for the first few years. This segment includes US citizens ( US Origin) too. Most the of the americans here have their spouse at home to take care of their kids first few years. It is not worth anybody's time and money to have a kid and put them in daycare from day one and go out and earn and pay half of it to daycare.

    Enough of above, even my wife is CPA and we are married for 5 years now. She came to US dreaming about working in professional CPA firm. But my ignorance about GC process then cost her her career. She was depressed initially. I am an easy go guy and convinced her not to worry much about job. We planned and now we have 3+ year girl and a 3 weeks+ boy. Her mind is all set towards taking care of our kids and I am free from those job hunting depressions. Once both of our kids reaches 5+, she may again start to think about career. May be by then, by Gods grace, I hope to have my GC. I bought a house this year and we all live happily knowing all the uncertanites of H1. We knew it is risk to buy a house. But ultimately what is going to happen. Is anyone going to behead you in case you default or loose job? What the heck, file bankruptcy and go back to home country. At least the days we live here, we live in peace and enjoy. If you have this mindset, you will think clearly and will take positive decisions. Otherwise, everyday is hell in US for immigrants with the current GC process.

    Getting GC and earning is not everything. It is only very very small part of life. Forget about it and live today's life with what you have. Worry about things which you can control. All other things will follow you automatically. Having kids is in your hand and you have to have this sooner or later. Always, sooner the better and you can use this retrogression as an opportunity to execute those projects instead of worrying over it. GOOD LUCK.

    I applied for EAD and AP renewal on June 30. I received AP approval on July 18th and got EAD approved on August 15th.

    in 2005 there was visa recapture for nurese (50,000). Why can not this be done now? They could have simply post information in June saying July Visa bultien revised. Why costing people all this money ? The least the USCIS should do is not to reject all these applications and but them to be processed in Octobor. It's not only miscomunication it's miss managing as well.

    FYI, people who sent applications on Jun 22th to NSC and their I-140 were approved at TSC, have not received receipts yet.

    NSC is around 10 days ahead TSC issuing receipts.

    I would say, July filers be patient.

    Receipt Notice: July 03, 2008
    LUD: July 08, 2008
    Current Status: My case was approved and card production ordered on August 14, 2008 (got the email from CRIS) and still waiting for my spouse's EAD approval.

    Raghav, congrats and thanks for the update.

    Is July 08, 2008 also the Notice Date on your receipt notice? I'm wondering if generally there is one more LUD after the notice date and before the approval, when they pull the file off the shelf and start working on the case.

    Diptam, Don�t leave the employer but force them to terminate you after 160 days of filing I-485. Don't clear any client interview and force them to pay you salary as it is employers job to give you work. Take rest at home on full salary. A time will come when employer will no longer afford to loose any more money and they will terminate you. Also ask for severance package when they terminate you.
